Platform Role — Marketplace Disclaimer
Safari Hunts is a technology platform that connects Hunters with Outfitters and Service Providers. We are NOT a hunting operator, outfitter, professional hunter, travel agent, or tour operator.
We do not own, operate, manage, or control any farm, game reserve, concession, or hunting operation listed on the Platform. Safari Hunts does not employ any Professional Hunters, guides, trackers, or field staff. The Outfitter is solely and exclusively responsible for the hunting experience, including but not limited to safety protocols, permits, licences, regulatory compliance, accommodation, meals, and all on-the-ground logistics.
Safari Hunts facilitates the booking process, payment processing, communication between parties, and document tracking. Our role is limited to providing the technology platform and associated services. The contractual relationship for the hunting experience exists directly between the Hunter and the Outfitter. Safari Hunts is not a party to that contract.
By using the Platform, you acknowledge and agree that Safari Hunts bears no responsibility or liability for the acts, omissions, errors, representations, warranties, negligence, or breaches of any Outfitter, Professional Hunter, or Service Provider.
3.
Eligibility
To register for and use the Platform, you must:
- Be at least 18 (eighteen) years of age or the age of legal majority in your jurisdiction, whichever is greater.
- Provide accurate, current, and complete registration information, including a valid email address and, where applicable, a contactable WhatsApp number in E.164 format.
- Maintain only one (1) account per natural person. Duplicate accounts may be suspended or terminated without notice.
Additional requirements for specific roles:
- Outfitters / Farm Owners: Must hold valid outfitter licences and/or hunting concession permits issued by the relevant provincial or national authority in each jurisdiction in which they operate. In South Africa, this includes valid registration with the relevant provincial nature conservation authority.
- Professional Hunters: Must hold a valid PH licence issued by the relevant provincial authority and, where applicable, endorsements for dangerous game (DG) species. PH licence details must be uploaded to the Platform for verification.
- Service Providers: Must hold all licences, permits, and insurance policies required by law to provide their services, including but not limited to taxidermy permits, freight operator licences, air charter operator certificates (AOC), and food safety certifications.
Safari Hunts reserves the right to verify the credentials, licences, and representations of any user. We may request documentary proof of licences or qualifications at any time. Accounts that cannot be verified, or that are found to contain false or misleading information, may be suspended or permanently terminated at our sole discretion.
4.
Account Security
- You are solely responsible for maintaining the confidentiality of your account credentials, including your password and any two-factor authentication (2FA) recovery codes.
- You must notify Safari Hunts immediately at [email protected] if you become aware of or suspect any unauthorised access to your account.
- Two-factor authentication (2FA) via TOTP (Time-based One-Time Password) is available on all accounts and is strongly recommended. Users who enable 2FA benefit from an additional layer of security when logging in.
- Safari Hunts is not liable for any loss, damage, or liability arising from unauthorised access to your account where such access results from your failure to maintain adequate password security, your failure to enable available security features, or your disclosure of credentials to third parties.
- You must not share your account with any other person or allow any other person to access the Platform using your credentials.
5.
Listings and Content
Outfitter obligations:
- Outfitters warrant and represent that all listings published on the Platform are accurate, complete, lawful, and not misleading in any material respect.
- All species listed must be legally huntable under the applicable provincial, national, and international laws and regulations. Species that require special permits (TOPS, CITES, DG endorsements) must be clearly identified.
- Pricing displayed on listings must include all mandatory costs, including daily rates, trophy fees, and compulsory extras. Hidden fees not disclosed in the listing are prohibited.
- All photographs and media used in listings must be genuine, must accurately depict the farm or concession, and must be owned by or validly licensed to the Outfitter. Stock photography must not be used to misrepresent a property.
- Listings that are found to be materially inaccurate, misleading, or in violation of these Terms may be removed by Safari Hunts without prior notice.
User-generated content:
- All user-generated Content, including reviews, photographs, and messages, must be truthful, based on genuine direct experience, and must not be defamatory, obscene, threatening, or in violation of any applicable law.
- Users must not upload Content that infringes the intellectual property rights of any third party.
- Safari Hunts reserves the right to remove any Content that violates these Terms at its sole discretion and without prior notice.
6.
Bookings
A Booking constitutes a binding agreement between the Hunter and the Outfitter for the provision of a hunting experience. Safari Hunts is not a party to this agreement and acts solely as a technology intermediary facilitating the transaction.
To create a Booking, the Hunter must select:
- The farm or concession;
- Arrival and departure dates;
- Party size (number of hunters and observers);
- Species or package selection; and
- Any additional services (shuttle, charter, chef, etc.).
A Booking is confirmed only when the required deposit has been successfully processed and the Outfitter has accepted the Booking through the Platform. Until both conditions are met, no binding obligation exists between the parties.
A deposit of 50% (fifty per cent) of the daily-rate accommodation cost (number of nights × the daily rate, plus any compulsory extras) is required to confirm a Booking. The remaining 50% (fifty per cent) of the daily-rate cost is due 90 (ninety) days before the arrival date — or immediately, where the Booking is made within 90 days of arrival. Trophy fees are variable, depend on the animals actually taken during the hunt, and are invoiced separately after the hunt; they are not included in the deposit or the daily-rate balance. The Platform Fee is included in the amounts charged to the Hunter and disclosed at the time of Booking. Failure to pay the balance by the due date may result in cancellation of the Booking in accordance with the cancellation policy set out in Section 8.
Each Booking is assigned a unique reference number in the format AH-YYYY-NNNN. This reference must be quoted in all communications regarding the Booking.
7.
Payments and Escrow
Payments on the Platform are processed through the following payment processors:
- Ozow — Instant EFT payments in South African Rand (ZAR) for South African bank account holders.
- Peach Payments — International card payments (Visa, Mastercard, American Express) in USD, EUR, and GBP.
Safari Hunts does not store, process, or have access to credit card numbers or bank account details. All payment processing is handled by PCI DSS-compliant third-party payment processors.
Deposits are held in escrow by our payment processing partners until the Booking is marked as completed by the Outfitter through the Platform. Upon confirmation of hunt completion, the escrowed funds are released to the Outfitter, less the Platform Fee as defined in Section 1 and disclosed at the time of Booking.
The Platform Fee is earned upon Booking confirmation and is non-refundable once the Booking has been confirmed, except in the case of Outfitter cancellation or Force Majeure as described in Section 8.
Currency and exchange rates:
- All prices on the Platform are displayed in United States Dollars (USD) by default, unless the Hunter selects a different display currency (ZAR, EUR, or GBP).
- Display exchange rates are indicative only and are updated periodically. The final charge to the Hunter's payment method will be processed in the selected payment currency at the prevailing exchange rate at the time of payment.
- A foreign exchange markup of up to 2% (two per cent) may be applied to currency conversions to account for exchange rate volatility. This markup is disclosed on the payment summary before the Hunter confirms payment.
- Safari Hunts is not liable for fluctuations in exchange rates between the date of Booking and the date of payment, or between the date of payment and the date of any refund.
8.
Cancellation and Refund Policy
8.1 ECT Act Cooling-Off Period
In accordance with Section 44 of the Electronic Communications and Transactions Act 25 of 2002, Hunters who make Bookings through the Platform have the right to cancel the Booking without reason and without penalty within 7 (seven) business days of the date on which the Booking is confirmed. To exercise this right, the Hunter must send written notice of cancellation to [email protected] within the cooling-off period. Upon valid cancellation under this section, a full refund of all amounts paid will be processed within 30 (thirty) days.
8.2 Hunter Cancellation (after cooling-off period)
After the expiry of the cooling-off period described in Section 8.1, the following cancellation schedule applies to the deposit paid by the Hunter:
| Cancellation Timing |
Refund |
| More than 180 days before arrival date |
Full deposit refund, less R500 / $30 administration fee |
| 90 – 180 days before arrival date |
50% of the deposit refunded |
| 30 – 89 days before arrival date |
25% of the deposit refunded |
| Less than 30 days before arrival date |
No refund — deposit forfeited to the Outfitter |
| No-show (failure to arrive) |
No refund — deposit forfeited to the Outfitter |
All refunds will be processed within 30 (thirty) days of the cancellation request, subject to payment processor processing times. Refunds are made to the original payment method used for the deposit.
8.3 Outfitter Cancellation
If the Outfitter cancels a confirmed Booking for any reason, the Hunter is entitled to a full refund of all amounts paid, including the Platform Fee. The refund will be processed within 14 (fourteen) days of the cancellation. Outfitters who cancel confirmed Bookings may be subject to penalties including listing suspension, reduced search ranking, or account termination at the discretion of Safari Hunts.
8.4 Force Majeure
Neither party shall be liable for failure to perform or delay in performing any obligation under these Terms where such failure or delay results from circumstances beyond the reasonable control of that party, including but not limited to:
- Government-imposed hunting bans, moratoria, or quota suspensions;
- Natural disasters, including floods, drought, wildfire, earthquakes, and severe storms;
- Epidemics, pandemics, or quarantine restrictions;
- War, armed conflict, terrorism, civil unrest, or insurrection;
- Visa denial by a government authority (where the Hunter has applied in good faith and in a timely manner); and
- Suspension or closure of international borders or airspace.
In the event of a Force Majeure occurrence, Safari Hunts will facilitate either rescheduling of the Booking to a mutually agreed alternative date or a full refund, at the Hunter's election. Any dispute regarding whether a Force Majeure event has occurred shall be determined by Safari Hunts acting reasonably.
8.5 Travel Insurance
Safari Hunts strongly recommends that all Hunters obtain comprehensive travel insurance and trip cancellation insurance before travelling. Safari cancellation insurance is available from specialist providers and is strongly advised given the significant costs associated with international hunting safaris.
Safari Hunts is not an insurance provider, insurance broker, or financial services provider. We bear no liability for uninsured losses resulting from cancellation, interruption, illness, injury, loss of property, or any other event during the course of travel or the hunting experience.
9.
Hunting Permits, CITES, and Regulatory Compliance
The Outfitter is solely and exclusively responsible for obtaining all hunting permits, provincial hunting licences, TOPS (Threatened or Protected Species) permits, CITES export permits, veterinary certificates, and any other regulatory approvals required for the hunting experience and the export of trophies.
Safari Hunts does NOT guarantee the availability of hunting permits, CITES quota allocations, trophy export approvals, or any regulatory outcome. Permit availability is subject to government authority decisions outside the control of Safari Hunts.
- Species listed as CITES Appendix I or Appendix II are clearly identified on the Platform. Hunters must independently verify the import requirements and restrictions applicable in their home country before making a Booking for any CITES-listed species.
- The importation of hunting trophies into the United States of America is subject to the regulations of the U.S. Fish and Wildlife Service (USFWS), including enhancement findings under the Endangered Species Act. Safari Hunts makes no representation or warranty regarding the eligibility of any trophy for import into the United States or any other jurisdiction.
- The Hunter is solely responsible for obtaining all import permits, firearms permits, and customs declarations required by the laws of their home country.
- Safari Hunts is not liable if a trophy cannot be exported from the country of origin or imported into the Hunter's home country due to regulatory changes, permit denials, quota exhaustion, CITES restrictions, or any other regulatory action.
- Hunters booking dangerous game (DG) species acknowledge the inherent risks involved and confirm that they understand the requirement for medevac insurance and the additional safety protocols that apply.
10.
Trophy Shipment
Safari Hunts provides a document tracking system (the "Trophy Shipment Engine") that enables all parties to a Booking to upload, track, and monitor the progress of documents required for the processing and shipment of hunting trophies. The document chain includes permits, certificates, dip-and-pack documentation, airway bills, customs clearances, and delivery confirmations.
- The Outfitter is responsible for hunt completion certificates, quota permits, and initial CITES export documentation.
- The taxidermist is responsible for dip-and-pack certificates, trophy inventories, phytosanitary certificates, and taxidermy CITES export documentation.
- The freight agent is responsible for airway bills, CITES re-export certificates (where applicable), customs clearance documentation, and delivery confirmations.
- The Hunter is responsible for import permits, firearms declarations, and hunting licence documentation.
Freight tracking is provided through integration with Shipsgo (a third-party logistics tracking aggregator) for informational purposes only. Safari Hunts is not a freight carrier, customs broker, taxidermist, or shipping agent.
Safari Hunts is not liable for any delays, damage, loss, confiscation, or destruction of trophies during processing, storage, or shipment. Trophy shipment is undertaken entirely at the Hunter's risk and cost, subject to the arrangements made between the Hunter and the relevant Service Providers.
11.
Reviews
- Only Hunters with verified, completed Bookings may submit reviews on the Platform. Reviews are verified against the booking record to ensure authenticity.
- Reviews must be truthful, fair, based on direct personal experience, and must not contain defamatory, abusive, discriminatory, or threatening language.
- Reviews must not contain personal contact information, commercial solicitations, or links to external websites.
- Outfitters have the right to respond to reviews left on their listings. Responses are subject to the same content standards as reviews.
- Safari Hunts reserves the right to remove reviews that violate these guidelines, that are found to be fraudulent, or that are the subject of a valid legal complaint. We are not obligated to disclose the specific reason for removal.
- Once published, reviews may not be withdrawn or edited by the reviewer except through Safari Hunts moderation. This ensures the integrity and trustworthiness of the review system for all users.
12.
Limitation of Liability
Safari Hunts is a marketplace facilitator. To the maximum extent permitted by the laws of the Republic of South Africa, Safari Hunts, its directors, employees, agents, and affiliates shall not be liable for:
- The quality, safety, legality, or suitability of any hunting experience booked through the Platform;
- Personal injury, illness, disability, or death occurring during the course of a safari, hunt, or any related activity;
- The accuracy, completeness, or truthfulness of Outfitter listings, representations, or communications;
- The acts, omissions, negligence, or wilful misconduct of any Outfitter, Professional Hunter, Service Provider, or other third party;
- Weather conditions, animal behaviour, or hunting outcomes, including the availability, size, or quality of game;
- Customs, immigration, visa, or border control issues;
- Currency fluctuations, exchange rate differences, or foreign transaction fees beyond the disclosed FX markup;
- Interruptions, errors, or defects in the Platform, including downtime, data loss, or security breaches caused by third-party attacks;
- Loss of profits, revenue, goodwill, or anticipated savings arising from or in connection with the use of the Platform.
To the maximum extent permitted by South African law, the total aggregate liability of Safari Hunts to any user for any and all claims arising from or relating to the use of the Platform or any Booking shall not exceed the Platform Fee actually received by Safari Hunts in respect of the applicable Booking.
Nothing in these Terms excludes or limits liability for fraud, intentional misrepresentation, gross negligence, or death or personal injury caused directly by the proven negligence of Safari Hunts.
This limitation of liability is a fundamental element of the agreement between you and Safari Hunts and reflects the allocation of risk between the parties. Safari Hunts would not be able to provide the Platform on an economically reasonable basis without this limitation.
13.
Indemnification
You agree to indemnify, defend, and hold harmless Safari Hunts, its directors, officers, employees, agents, and affiliates from and against all claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising from or relating to:
- Outfitters: All claims arising from or related to the hunting operations, permit violations, licence failures, listing inaccuracies, safety incidents, environmental damage, or any breach of applicable hunting, conservation, or environmental legislation.
- Hunters: All claims arising from or related to unlawful conduct, false representations, violation of hunting regulations in any jurisdiction, importation of trophies in contravention of applicable law, or any breach of these Terms.
- All users: All claims arising from Content uploaded to the Platform that infringes the intellectual property rights of a third party, or from any use of the Platform in violation of these Terms or applicable law.
This indemnification obligation survives the termination of your account and these Terms.
14.
Intellectual Property
- The Safari Hunts name, logo, visual identity, website design, software, and all proprietary content are the exclusive property of Premier Safari Hunts (Pty) Ltd and are protected by South African and international intellectual property laws. No licence or right is granted to use any Safari Hunts intellectual property except as expressly authorised under these Terms.
- Content uploaded by users (including photographs, reviews, listing descriptions, and messages) remains the intellectual property of the uploading user. By uploading Content to the Platform, you grant Safari Hunts a non-exclusive, worldwide, royalty-free, transferable, sub-licensable licence to use, display, reproduce, modify, distribute, and create derivative works from such Content for the purposes of operating, promoting, and improving the Platform.
- Hunt photographs uploaded to the Platform may be watermarked with Safari Hunts branding and, where the user has consented via their profile settings, with sponsor branding. The original unwatermarked photograph remains accessible only to the uploading user.
- This licence survives the termination of your account for Content that has been shared, displayed, or incorporated into the Platform prior to termination. You may request deletion of your Content by contacting [email protected].
15.
Dispute Resolution
In the event of a dispute between a Hunter and an Outfitter arising from or relating to a Booking, the parties agree to follow this dispute resolution procedure:
- Step 1 — Direct communication: Disputes should first be raised through the Platform's integrated messaging system so that a written record of the dispute is maintained.
- Step 2 — Mediation by Safari Hunts: If the dispute cannot be resolved through direct communication within 14 (fourteen) days, either party may request that Safari Hunts mediate the dispute. Safari Hunts may mediate at its discretion but is not obligated to resolve disputes between users and shall not be liable for the outcome of any mediation.
- Step 3 — Formal proceedings: If the dispute remains unresolved after mediation, or if Safari Hunts declines to mediate, either party may pursue formal legal proceedings.
Any legal proceedings arising from or relating to these Terms or any Booking shall be subject to the exclusive jurisdiction of the High Court of South Africa, Gauteng Division, Pretoria, or such other division as may have jurisdiction over the parties. The parties consent to the jurisdiction of the said court and waive any objection to its jurisdiction.
Nothing in this clause prevents a party from seeking urgent interim relief from a court of competent jurisdiction.
16.
Termination
- Safari Hunts may suspend or terminate your account immediately and without prior notice if you breach any material provision of these Terms, engage in fraudulent or unlawful activity, or if Safari Hunts reasonably believes that your continued use of the Platform poses a risk to other users, to Safari Hunts, or to the integrity of the Platform.
- Safari Hunts may also terminate accounts that have been inactive for a period exceeding 24 (twenty-four) consecutive months, after providing 30 (thirty) days' written notice to the email address on file.
- You may delete your account at any time through your profile settings on the Platform, or by contacting [email protected].
- Upon termination, your right to access and use the Platform ceases immediately. However, all outstanding Booking obligations, payment obligations, indemnification obligations, and dispute resolution provisions survive termination and continue to bind the parties until fully discharged.
- Safari Hunts will retain your personal information for the period required by applicable law (including POPIA and the Income Tax Act) following account termination. Thereafter, your personal information will be de-identified or destroyed in accordance with our Privacy Policy.

Safari Hunts reserves the right to amend, modify, or replace these Terms of Service at any time. Where we make material changes that affect your rights or obligations, we will provide at least 30 (thirty) days' prior notice via email to the address registered on your account. Non-material changes (such as typographical corrections, formatting, or clarifications that do not alter the substance of the Terms) may be made without prior notice.
The date of the most recent revision will be indicated at the top of these Terms under "Last updated." Your continued use of the Platform after the effective date of any amendments constitutes your acceptance of the revised Terms. - Any personal injury, property damage, or loss arising from activities arranged or facilitated through the Platform, including inherent risks associated with hunting, wildlife encounters, travel, and outdoor activities;
- Any claim by a third party relating to your acts or omissions in connection with services offered or procured through the Platform.
You acknowledge that hunting and related outdoor activities carry inherent risks, including but not limited to risk of serious injury or death, and that Premier Safari Hunts (Pty) Ltd acts solely as a marketplace facilitating connections between parties and does not itself provide hunting, outfitting, taxidermy, freight, or professional hunting services.
This indemnity shall survive the termination or expiry of your account and these Terms.
